Often, the Cadastre does not have the current details with regards to the current owner and current borders of the real estate property. This imposes the necessity of checking the cadastre and corrects the data if needed.
Division of non-regulated real estate properties situated outside the building borders concerns the division of agricultural plots. There are certain requirements for the minimum allowed shares to be hold by each owner, as follows:
- 3 decare for the fields;
- 2 decares for lawns;
- 1 decare for veneyard and other long-term culture.
The necessity of changing the borders of real estate properties arises in the following cases:
- Before commencement of building;
- When there is no access to communication services (water, electricity ect);
- When the real estate property is in ‘ideal co-ownership’;
- When there are pending regulation notes ect.
With the tracing of the real estate property, there are being defined its exact borders (the lie of the land). A protocol with the coordinates of the real estate property is being given.
A regulated real estate property is real estate property, for which with a ‘detailed layout plan’ are defined borders, access from road, street or alley, a specific purpose of use and regime of structure’. The regulation of real estate properties is a procedure implemented through a detailed layout plans.
Preparation or alteration of detailed layout plans is needed in the following cases:
- Subdivision of a substantial plot of land / real estate property to smaller pieces;
- Sale of part of the whole real estate property;
- Regulation of real estate property with purposes for building;
- Court decision to subdivide a regulated real estate property;
- Changing of the purposes of use of agricultural lands.
Non-regulated real estate property is a real estate property that falls in a territory which is not regulated with a detailed layout plans. In order to commence a building on such territories, there is a need to have a current operative detailed layout plan; and to conduct a change of the purposes of use of the territory.
A regulated real estate property is a real estate properties for which there are defined with a detailed layout plan: borders, access from street, road or alley, concrete purpose of use and layout regime. The purpose of use is a subject of change when for example: residential territories are being differentiate as a trade centers or some other economic activities; or the other way around.
